Wife's alimony in the Waiting Period: Fiqh Jurisprudence vs. Jordanian Marital Status Law No. 36 of 2010

Abstract

The present study reports and investigates the views of Fiqh scholars on matters related to the alimony assigned to the wife in the waiting period in the case of divorce or death, especially on how to pay it. Then, these opinions are compared to relevant articles in the Jordanian Marital Status Law, so that similarities and differences would be spotted against traditional Fiqh sources. To this end, the scientific method is followed to quote, document, discuss and reconcile them. It is concluded that the law in question is in line with priority and choice methods under the principles and objectives of the Sharia as well as with the methodology announced to derive law from Fiqh sources.
